Terms of Service

Welcome to hltape.xyz ("Service"), operated by the team behind hltape.xyz ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description & Non-Custodial Nature

hltape.xyz provides automated trailing stop-loss and take-profit order management tools for the Hyperliquid decentralized exchange ("Hyperliquid DEX"). The Service monitors your open positions and places, modifies, or cancels orders on Hyperliquid on your behalf based on parameters you configure.

The Service is strictly non-custodial. We do not hold, control, or have the ability to withdraw, transfer, or access your funds at any time. All your funds remain entirely in your control and are secured by the smart contracts managed by the Hyperliquid DEX.

3. Wallet Authentication & Agent Authorization

The Service uses wallet-based authentication. You are solely responsible for the security of your wallet, private keys, and seed phrases. We never have access to your Layer 1 private keys.

To provide the Service, you must authorize hltape.xyz to act as an "Agent" on your Hyperliquid account. By doing so, you grant the Service permission to execute, modify, and cancel orders on your behalf based on your configured parameters. You acknowledge that you can revoke this Agent access at any time directly through the Hyperliquid interface. Any action performed by our Service using your Agent authorization is considered authorized by you.

4. No Financial Advice

The Service is a technical execution tool — not a financial advisor. Nothing provided by hltape.xyz constitutes financial, investment, tax, or legal advice. All trading decisions are made by you. You should consult with qualified professionals before making any trading decisions.

5. ASSUMPTION OF RISK (USE AT YOUR OWN RISK)

YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. WE TAKE ABSOLUTELY NO RESPONSIBILITY FOR ANY FINANCIAL LOSSES. Cryptocurrency trading involves a substantial risk of loss. By using this Service, you acknowledge and completely accept:

We strive to maintain high availability but do not guarantee uninterrupted, timely, or error-free access to the Service. We may:

7. Fees

hltape.xyz does not charge any fees directly. All trading fees are collected exclusively by the Hyperliquid DEX in accordance with their fee schedule.

As part of setting up the Service, you are required to approve a "Builder Fee" on-chain. This is a standard Hyperliquid mechanism — a small fee (currently ~0.01%) that Hyperliquid includes in the trading fees it already collects on each trade. Hyperliquid then shares a portion of these fees with the builder (i.e., hltape.xyz) as compensation for directing trading activity to the exchange. This does not result in any additional cost to you beyond the standard Hyperliquid trading fees.

Approval of the Builder Fee is a one-time on-chain transaction and is required before you can use the automated trading features of the Service. You may revoke this approval at any time through the Hyperliquid interface.

8. Referral Program

By using the Service, you acknowledge and agree that hltape.xyz participates in the Hyperliquid referral program. If your Hyperliquid account is not already linked to a referral code, the Service will automatically associate it with the hltape.xyz referral code. Additionally, orders placed through the Service may include the hltape.xyz referral code. This is part of how the Service is able to remain free of charge.

Referral linking is a standard Hyperliquid feature and does not affect your trading fees or experience. If you wish to change your referral association, you may do so directly through the Hyperliquid platform. Please note that the Service will continue to include its referral code on orders placed on your behalf.

All content, code, design, and branding of hltape.xyz are owned by its operators and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the Service for its intended purpose.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS OF HLTAPE.XYZ SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF FUNDS, LIQUIDATIONS, OR DATA LOSS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE EXPRESSLY DISCLAIM ALL LIABILITY FOR THE PERFORMANCE OR FAILURE OF THE HYPERLIQUID DEX OR ANY THIRD-PARTY INFRASTRUCTURE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US IN THE THIRTY (30) DAYS PRECEDING THE CLAIM, OR $0 IF NO FEES WERE PAID.

12. Indemnification

You agree to indemnify and hold harmless the operators of hltape.xyz from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any law or rights of a third party.

13. Modification of Terms

We may update these Terms at any time. Material changes will be communicated through the Service. Continued use of the Service after changes constitutes your full acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without cause, and with or without notice. Upon termination, any open orders managed by the Service will no longer be monitored or updated by our bot.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to conflict of law provisions.

16. Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
